Making a personal injury claim

Personal injury solicitors bring claims for compensation after an injury that was someone else's fault: road traffic accidents, accidents at work, trips in public places and injuries from faulty products. Claims about medical treatment, known as clinical negligence, are a separate specialism, so check that a firm lists it if that is your case.

There is a time limit. In England and Wales a personal injury claim must normally be started within three years of the date of the injury, or of the date you first knew about it if that is later (Limitation Act 1980, section 11). There are exceptions, so ask a solicitor as soon as you can rather than near the deadline.

Most personal injury firms work on a no win, no fee basis, under a conditional fee agreement. Before you sign, ask what will be taken from your compensation if you win, what you would pay if you lose, and whether you need insurance to cover the other side's costs.

What to ask a firm

  • Ask who will do the work and who supervises it
  • Ask for a written quote or estimate, with what is and is not included, before anything starts
  • Ask how often you will get updates and by what route
  • Check the firm and the solicitor on the SRA register

Questions people ask

How long do I have to make a personal injury claim?

Normally three years from the date of the injury, or from the date you first knew about it if later (Limitation Act 1980, section 11). Different rules can apply to children and to people who lack mental capacity, so ask a solicitor about your own dates.

How does no win, no fee work?

The firm agrees not to charge its own fee if the claim fails. If you win, part of its fee is usually taken from your compensation. Read the agreement for what is deducted, any insurance premium, and what happens if you end the agreement early.

How much compensation will I get?

Nobody can tell you before your injuries and losses have been assessed. Compensation covers the injury itself and money you have lost or spent because of it, such as earnings and care. Be wary of any firm that promises a figure at the first call.

Should I accept an early offer from an insurer?

Get advice before you do. Accepting a settlement normally ends the claim, and an early offer may be made before the full effect of an injury is known.
