Help for landlords and tenants

Landlord and tenant solicitors act on both sides: for landlords on tenancy agreements, rent arrears and possession claims, and for tenants on disrepair, deposits and unlawful eviction. Many firms also handle commercial leases for shops and offices.

In England, a landlord who wants a tenant with an assured periodic tenancy to leave must give a section 8 notice. If the tenant does not leave by the date in the notice, the landlord applies to court for a possession order, and bailiffs can then remove the tenant under a warrant for possession (GOV.UK). Illegal eviction is a criminal offence that can lead to a prison sentence.

The rules are different in Wales, Scotland and Northern Ireland, so check that the firm advises on the country where the property is. Tenants facing eviction or serious disrepair may qualify for legal aid (GOV.UK).

What to ask a firm

  • Ask who will do the work and who supervises it
  • Ask for a written quote or estimate, with what is and is not included, before anything starts
  • Ask how often you will get updates and by what route
  • Check the firm and the solicitor on the SRA register

Questions people ask

How does a landlord evict a tenant in England?

For an assured periodic tenancy, by giving a section 8 notice, then applying to court for a possession order if the tenant stays, then applying for a warrant so that bailiffs can enforce it (GOV.UK). Skipping a step can make the eviction unlawful.

Can a landlord change the locks?

Not on a tenant with an assured tenancy, without a court order. Doing so may be harassment or illegal eviction (GOV.UK). Lodgers who live with the landlord usually have an excluded tenancy or licence and only need reasonable notice.

Can tenants get legal aid?

Legal aid can help with homelessness, eviction, losing your home and serious disrepair (GOV.UK). Check your eligibility on GOV.UK or call Civil Legal Advice on 0345 345 4345.

Do the same rules apply in Wales?

No. Wales has its own system for renting homes, and Scotland and Northern Ireland have their own eviction rules too (GOV.UK). Ask the firm whether it advises on property where yours is.
