What a lasting power of attorney does

A lasting power of attorney (LPA) is a legal document that lets you appoint one or more people, called attorneys, to make decisions for you if you lose mental capacity through an accident or illness. There are two types, health and welfare, and property and financial affairs, and you can make one or both (GOV.UK).

You must be 18 or over and have mental capacity when you make it. An LPA cannot be used until it is registered with the Office of the Public Guardian, which takes 8 to 10 weeks if there are no mistakes in the application, and it is legally binding only in England and Wales (GOV.UK). The registration fee is listed on GOV.UK.

Many people fill in the forms themselves. A solicitor earns their fee when family relationships are strained, when you own a business, when you want detailed instructions for your attorneys, or when there may be questions about capacity later.

What to ask a firm

  • Ask who will do the work and who supervises it
  • Ask for a written quote or estimate, with what is and is not included, before anything starts
  • Ask how often you will get updates and by what route
  • Check the firm and the solicitor on the SRA register

Questions people ask

Do I need a solicitor to make a lasting power of attorney?

No. You can make and register an LPA yourself on GOV.UK. Advice is worth paying for if your affairs are complicated, if you are worried someone may dispute it, or if you want help choosing attorneys.

How long does it take to register an LPA?

8 to 10 weeks if there are no mistakes in the application (GOV.UK). Errors send the form back, which is a common reason to ask a solicitor to check it before it is sent.

What happens if someone loses capacity without an LPA?

Nobody automatically has the right to make decisions for them. A relative or friend may have to apply to the Court of Protection to be appointed as a deputy (GOV.UK), which takes longer and involves ongoing supervision.

When can a health and welfare LPA be used?

Only when you are unable to make the decision yourself (GOV.UK). It can cover your daily routine, medical care, moving into a care home and, if you say so, life-sustaining treatment.
